Time Shares - What We Need to Know and Can Realtors Sell Them?

Real Estate Act Section 1(1)(t) under Time-shares states that:

In order for a time-share interest to come within the meaning of the Real Estate Act, a legal registrable interest in the property must be conveyed to the buyer of the time-share. The acquisition and disposition of time-share memberships i.e. vacation club memberships, are not within the jurisdiction of the Real Estate Act. The Real Estate Act offers some protection for the consumer who lives in Alberta and buys an out-of-Province real estate time-share while in Alberta.

Note: Realtors and Brokers are not to use ones brokerage's trust account to process a timeshare sales transaction unless it is for a timeshare with a title or deed. Only a very small percentage of timeshares are deeded. Over 90% of timeshares are NOT deeded.

Interpretation Guideline D-26 "Property User's License" available on the RECA website states,

"A property owner's license is a permission provided by an owner of property to another party for that party to use the property. In order for the Real Estate Act to apply, the Real Estate Council of Alberta requires that a legal interest in the property be conveyed i.e. an interest registrable against the property. Real estate brokers may trade in real estate in the disposition and acquisition of such licenses."

In future, only those sales of time-share units where a legal interest in the property is registerable against title should be considered real estate transactions. Further, unless this registration is required, the funds from the sale should not be deposited to a real estate trust account. Rule 36(3) states, "(3) A real estate brokerage shall keep the trust records of its business with respect to trades in real estate in Alberta separate from those that pertain to any other business.
